The family generally must present a written government claim within six months after the cause of action accrues (when the claim legally starts). If that step is missed, the law allows only a limited request to file late. If you are reading this after a loss, you do not need to know these rules yet. This guide explains the deadline, what must be proven, what heirs can recover, and what happens next.

What This Claim Is and Who It Covers

A wrongful death claim against city or county in California is a claim that a death was caused by a dangerous condition of public property. Public property is real or personal property that the public entity owns or controls (Gov. Code § 830). Roads and sidewalks that a city or county owns or controls are one example.

A dangerous condition creates a substantial risk of injury. A minor or trivial problem does not count when people use the property with due care (Gov. Code § 830).

This claim works differently from a claim against a private driver or business. Before a family can sue a public entity, it must present a written claim and wait for that claim to be acted on or deemed rejected (Gov. Code § 945.4) (California Courts Self Help Guide).

Families may face this situation after a crash, a pedestrian incident, or another event tied to a dangerous road or public property. A single crash can involve both a private driver and a public road owner. Each one follows its own rules.

If your family lost someone on a road or property a city or county controls, the six-month clock may already be running, and we can talk through your options. Code § 911.2). That is much shorter than the general limit for other death claims.

For a death caused by a private person, the general limit is two years (Code Civ. Proc. § 335.1). Families who assume that longer period applies to a city or county can run out of time for the first step.

Two more rules matter once the claim is filed:

If the public entity rejects the claim and written notice is given in accordance with Gov. Code § 913, a lawsuit must be commenced not later than six months after that notice is personally delivered or deposited in the mail (Gov. Code § 945.6). If written notice is not given in accordance with Section 913, the suit must be commenced within two years from the accrual of the cause of action.

A late claim may still be possible through an application for leave. It must be made within a reasonable time, not more than one year after accrual. It must state the reason for the delay and attach the proposed claim (Gov. Code § 911.4).

Because the start date can be a legal question, do not wait for the investigation to finish (San Bernardino County Coroner) before acting.

What You Must Prove Against a Public Entity

A family must show that the property was dangerous and that the danger caused the death. The family must also show a link to the public entity’s conduct or knowledge. The statute sets out these elements (Gov. Code § 835) (Judicial Council of California civil jury instructions).

The condition must have created a reasonably foreseeable risk of the kind of injury that happened. A negligent or wrongful act or omission of a public employee, acting within the scope of employment, must have created the condition, or the entity must have had notice of it in time to protect against it (Gov. Code § 835).

Actual notice means the entity knew of the condition and knew or should have known it was dangerous (Gov. Code § 835.2). Cal. Gov. Code § 835.2 reads: “(b) A public entity had constructive notice of a dangerous condition within the meaning of subdivision (b) of Section 835 only if the plaintiff establishes that the condition had existed for such a period of time and was of such an obvious nature that the public entity, in the exercise of due care, should have discovered the condition and its dangerous character.” Constructive notice is harder to prove. The condition must have existed long enough, and been obvious enough, that a reasonable inspection would have found it (Gov. Code § 835.2).

Evidence that often matters includes:

Crash or incident reports

Repair and maintenance records

Prior complaints about the same spot

Photographs taken soon after the event

Inspection logs

What a Wrongful Death Claim Can Recover

Certain family members can bring the claim. Under California law, a surviving spouse, domestic partner, children, and certain other heirs may sue for a wrongful death (Code Civ. Proc. § 377.60).

Dependent stepchildren, parents, and certain others may also qualify. A minor who lived in the decedent’s household for the previous 180 days and relied on the decedent for half or more of support may qualify too (Code Civ. Proc. § 377.60).

A survival action covers losses the decedent suffered before death. In that action, damages generally do not include pain, suffering, or disfigurement (Code Civ. Proc. § 377.34(b), the damages recoverable may include damages for pain, suffering, or disfigurement if the action or proceeding was granted a preference pursuant to Section 36 before January 1, 2022, or was filed on or after January 1, 2022, and before January 1, 2026.

Public entities cannot be held liable for punitive damages, which are meant to punish the defendant (Gov. Code § 818).

The value of any claim depends on the losses proven and the facts of the case.

How a Claim Against a City or County Proceeds, Step by Step

The process moves from evidence, to a written claim, to the entity’s response, and then to a lawsuit if one is needed.

Preserve evidence. Gather the crash or incident report, photos, witness names, and any repair or warning history for the location.

Identify the owner. A road or sidewalk may belong to a city, a county, or another agency. It must also list the public employees involved, if known. A dollar amount, with how it was computed, appears only when the claim totals less than $10,000, counting the estimated amount of any future injury, damage, or loss known when the claim is presented; above that, no amount is stated, but the claim must say whether it would be a limited civil case (Gov.
