Certain family members, or the decedent’s personal representative on their behalf, may bring it. The claim can name the truck driver, the trucking company, and other parties whose conduct contributed to the crash. This page explains who can file, who may be held responsible, what the law allows families to recover, and which deadlines matter most. Colvin Accident Lawyers is based in Bakersfield, Kern County.

What a Fatal Truck Crash Lawsuit Is and Who It Is For

A wrongful death lawsuit lets certain survivors seek recovery when a person dies because of another party’s wrongful act or neglect. Under Code Civ. Proc. § 377.60, the decedent’s surviving spouse, domestic partner, children, and issue of deceased children can bring the claim. If there is no surviving issue, the persons who would inherit the decedent’s property by intestate succession can bring it. A putative spouse, children of the putative spouse, stepchildren, parents, or legal guardians if the parents are deceased can also bring it if they were dependent on the decedent. A minor can also bring it if, at the time of the death, the minor had lived in the decedent’s household for the previous 180 days and depended on the decedent for half or more of the minor’s support. The decedent’s personal representative can also bring it on their behalf.

If there is no surviving issue, the people who would inherit the decedent’s property by intestate succession may bring it. That group includes a surviving spouse or domestic partner. Dependent family members, such as stepchildren or parents, may also qualify. So may a minor who lived in the decedent’s household for the previous 180 days and relied on the decedent for half or more of their support.

A survival action is a separate claim. It seeks the losses the person suffered before death. Families often need to coordinate who files each claim, because the estate representative and the heirs may both have roles.

If you're handling funeral plans and insurance calls after a truck crash, you may have a claim, and you don't have to figure it out alone. These claims have a short clock. A claim for death must be presented not later than six months after the claim accrues (Gov. A claim filed today falls outside that window.

The court also decides how an award is shared among the people entitled to it (Code Civ. Proc. § 377.61).

Punitive damages have a high standard. Under Civ. Code § 3294, in an action for the breach of an obligation not arising from contract, punitive damages require clear and convincing evidence of oppression, fraud, or malice. An employer answers for an employee’s conduct this way only in limited situations. Those include advance knowledge of the employee’s unfitness with conscious disregard of others’ rights or safety, authorizing or ratifying the conduct, or personal guilt. For a corporate employer, the knowledge, authorization, ratification, or conduct must be on the part of an officer, director, or managing agent of the corporation.

The value of any claim turns on the crash, the decedent’s circumstances, and the evidence. No website can predict a dollar range.

The Evidence That Matters in a Fatal Truck Crash Case

Key proof in a truck case often sits with the trucking company. Families should move early to preserve it.

Truck data. The engine’s electronic control module can record speed, braking, and throttle before impact.

Post-accident testing. After a fatal crash, 49 CFR 382.303 requires the employer to test each surviving driver who was performing safety-sensitive functions. If an alcohol test is not given within two hours, the employer must keep a written record of why. Controlled substance testing attempts stop after 32 hours.

Driver qualification files. 49 CFR 391.51 requires carriers to keep a file for each driver. It includes the application, motor vehicle record, and medical certificate. 49 CFR 391.51

Maintenance records. 49 CFR 396.3 requires carriers to inspect, repair, and maintain their vehicles. Maintenance records must be kept for one year, and for six months after the vehicle leaves the carrier’s control.

Crash scene proof. Police reports, nearby camera footage, witness statements, and roadway measurements all help.

Some of these records have fixed retention periods, and some are short. That is why an early written request to preserve evidence matters.

Insurance, Coverage, and Why Policy Limits Matter

Federal insurance rules set minimums, not the total money available in every case. Under 49 CFR 387.9, the federal minimum financial responsibility (public liability insurance) level for for-hire interstate carriage of nonhazardous property is $750,000 for vehicles rated 10,001 pounds or more; this is a required insurance floor, not a measure of what any claim is worth.

That figure is a floor. A fatal crash may also involve more than one policy, such as the carrier’s, the driver’s, or an excess layer.

Families should understand the full scope of the claim before signing any release. Accepting an early payment can also limit options, so take time to learn the facts first.

Timeline and What to Expect After Contacting an Attorney

Most fatal truck cases move through the same general stages. The pace varies with each case.

Consultation. The family shares the crash details, the decedent’s background, and who may bring claims.

Preservation. Written requests ask the carrier to keep its records and the truck’s data.

Investigation. Police reports, insurance information, and government claim deadlines are reviewed.

Claims and filing. Claims go to insurers. A lawsuit follows if needed. Under Code Civ.
