There is no single answer. The amount depends on the injuries, the losses they cause, who was at fault and what insurance is available. In California, a claim is built from documented damages, and specific rules shape each part. This guide explains those parts in plain terms.

Why a Motorcycle Accident Claim Has No Single Dollar Figure

No single dollar figure applies to every motorcycle accident. Each claim is valued on its own facts.

Two riders can crash on the same road and leave with very different injuries. One may need a few weeks of care. Another may need surgery, long rehabilitation and time away from work. The motorcycle itself doesn’t set the value. The documented losses do.

A single average can’t describe one rider’s injuries, bills or fault facts. Treating an average as a target can create a false expectation about what a claim is worth.

Many readers are hurt themselves. Others are helping a parent, spouse or child who was hurt or killed. Most want to understand what is possible and what they will need to prove. For an overview of how these cases are handled, see our motorcycle accident lawyer page.

If you're reading this after a crash, or for a rider you love, we can talk through the injuries, bills and insurance calls in a free, confidential first consultation with no obligation to continue. These include medical expenses, lost earnings, burial costs and the cost to repair or replace damaged property. For a rider, that can mean the motorcycle, a helmet, riding gear and personal items destroyed in the crash.

Non-economic damages are subjective losses. These include pain, suffering, inconvenience, emotional distress and loss of companionship. They are harder to put on paper. Medical history, the daily effects of the injury and statements from people who know the rider often support them.

Documentation drives the claim. Medical records, pay stubs, employer letters, repair estimates and provider bills each prove a piece of the loss. Keep copies of everything. Ask providers for itemized bills.

Injury Severity and Medical Documentation

The type, severity and permanence of an injury shape what a claim can document more than any other factor. A broken wrist that heals fully is a different claim from a spinal injury that changes how a person walks, works or cares for family.

Motorcycle crashes often cause fractures, road rash, head injuries and spinal injuries. In serious cases they can cause amputations. Each injury brings different treatment, different costs and different limits on daily life.

Catastrophic injury cases focus on long-term needs. These can include ongoing medical care, home changes and lost earning capacity. Learn more on our catastrophic injury lawyer page.

Treatment matters too. Timely, consistent care creates a clear record that links injuries to the crash. A rider who waits weeks to be seen may face the argument that a later injury came from something else. Gaps in treatment give insurers a reason to question the connection. Keep every appointment, follow the care plan and write down symptoms as they change.

How Fault and California’s Comparative Fault Rule Affect Recovery

Fault disputes in motorcycle crashes often involve left turns across a rider’s path, lane position, speed and following distance. California law says a driver must not follow another vehicle more closely than is reasonable and prudent, under Vehicle Code § 21703.

The other side can try to rebut that presumption. Lane splitting is a common question. The California Highway Patrol explains how California treats it.

Impairment changes the math. Under Civil Code § 3333.4, a rider convicted of driving under the influence in the crash may not recover non-economic losses.

Police reports, witness statements, vehicle damage and video can show who did what. For how turning-vehicle crashes are analyzed, see our left-turn motorcycle accident page.

Insurance Coverage and Policy Limits

The at-fault driver’s policy limits set a ceiling on what that policy will pay. Each liability policy states a limit per person and per accident.

Minimum limits are set by law. For policies issued or renewed on or after January 1, 2025, Vehicle Code § 16056 requires at least $30,000 for one injured person and $60,000 for two or more. These figures are minimums, not the value of a crash. A serious injury can cost far more than a minimum policy pays.

When the at-fault driver has no insurance, or too little, a rider’s own coverage may matter. California’s insurance code defines an uninsured motor vehicle to include one with no applicable bodily injury insurance. See Insurance Code § 11580.2. Whether that coverage applies depends on the policy and the facts.

Adjusters often make contact early. They may ask for a recorded statement or a signed release. Both can affect a claim. Take time before you respond.

Wrongful Death and Claims Brought by Families

When a motorcyclist dies, certain family members may bring a wrongful death claim under California law. Code of Civil Procedure § 377.60 lists who may sue. The decedent’s personal representative may also bring the claim on their behalf.

A survival claim brought for the person’s own losses is different. Code of Civil Procedure § 377.34 generally limits those damages to losses the person sustained before death. Code of Civil Procedure § 377.34 generally does not allow damages for pain, suffering or disfigurement in an action brought by a decedent’s personal representative or successor in interest, but subdivision (b) permits them only for actions granted a preference before January 1, 2022, or filed on or after January 1, 2022, and before January 1, 2026.

Deadlines matter. Under Code of Civil Procedure § 335.1, an action for injury or death caused by another’s wrongful act must be brought within two years. An action for assault, battery, or injury to, or for the death of, an individual caused by another’s wrongful act must be brought within two years. This section does not set a deadline for damage to the motorcycle itself.

Families may be planning a funeral while asking these questions. Others move into a lawsuit when those talks stall.

Timing depends on how long the injuries take to settle, how much treatment is needed and whether fault is disputed. A claim with clear fault and limited treatment can move faster than one with surgery and a contested liability question.

A claim’s value usually can’t be set until the medical picture is clear. Settling before the full course of treatment is known can leave later bills unpaid. Expect the process to take time. A fast payment isn’t something a rider should plan around.

Common Mistakes That Can Reduce a Motorcycle Claim

Several common errors can make a motorcycle claim harder to prove. Each one can be avoided.

Delaying medical evaluation is the first. Get checked when symptoms appear, even if the injury seems minor. A prompt record ties the injury to the crash.

Giving a recorded statement or signing a release too early is the second. Before the full injury is known, a statement can leave out important facts. A signed release can close off later claims, so read it carefully.

Social media posts are the third. Posts about riding, activity or the crash can be used to question the injury. Keep posts private or silent while the claim is open.

Losing evidence is the fourth. Keep the motorcycle, helmet and gear. California requires all riders, including passengers, to wear helmets, according to the Insurance Institute for Highway Safety. Take photos and keep a written log of symptoms and expenses.

Talking Through Your Motorcycle Accident Claim With Colvin Accident Lawyers

You can talk through your motorcycle claim with Colvin Accident Lawyers before you answer an insurer’s questions or weigh an offer. You may be recovering from an injury, caring for someone who was hurt, or sorting out bills and lost income.

How much compensation for a motorcycle accident?

There is no set amount. Value depends on documented losses, the injuries, fault and available insurance.

Can I still recover if I was partly at fault?

The answer depends on the facts and law of each case. Some limits apply, such as those in Civil Code § 3333.4. That section generally does not allow non-economic losses, such as pain and suffering, in three situations: when the injured person was operating a vehicle in violation of Vehicle Code § 23152 or § 23153 and was convicted of that offense; when the injured person owned a vehicle in the accident that was not insured as state law requires; or when the injured person was an operator who cannot establish financial responsibility as state law requires. There is an exception for the uninsured owner. That person is not barred if the other driver was convicted under Vehicle Code § 23152 or § 23153 for the crash.

How long do I have to file?

Injury claims generally must be filed within two years under California law, with exceptions (Code Civ.
