Why the Number Alone Doesn’t Answer It

A $50,000 settlement cannot be called good or bad on its own. The answer depends on the injuries, the treatment, the lost income, and who was at fault. Those facts decide whether the number fits the claim.

Picture an insurance adjuster calling with a $50,000 offer. Medical bills keep arriving. A spouse or adult child is trying to make sense of it all. That is a hard place to be, and the questions come fast.

An offer is the insurer’s proposal. It is not the money you take home. The amount you keep is a different figure, and the gap between the two can be large.

This page explains the pieces. It shows how a gross figure becomes a net figure, which facts change a claim’s value, and what to ask before you respond. A net settlement is what the injured person actually receives after those deductions come out.

Deductions usually come out in a set order. The main categories are attorney fees, case-related costs, medical liens and bills, and any other legally required repayments. Each one lowers the gross figure.

Here is a simple, illustrative example. It is not a prediction of what any real case will pay. Start with a $50,000 gross offer. Subtract the attorney fee set in the written agreement. Subtract case costs. Subtract the medical liens and bills that must be repaid. What remains is the net amount.

The written fee agreement and the final settlement statement show the actual deduction amounts. Ask to see both before you make a decision. Numbers on a flyer or a phone call are not the same as the numbers on those documents.

Attorney Fees and Case Costs

Attorney fees pay the lawyer. Case costs pay for the work done on the claim, such as medical records, filing fees, and reports from outside professionals. The two are separate, and both can reduce what you receive.

California law sets rules for written contingency fee agreements. The agreement must state the fee rate. It must also explain how costs affect the fee and your recovery. And, unless the claim is subject to the provisions of Section 6146, it must say the fee is not set by law but is negotiable between attorney and client. See Bus. & Prof. Code § 6147.

Those rules matter because an agreement that does not follow them can be voidable at the client’s option, though the attorney is then still entitled to collect a reasonable fee. Under Bus. & Prof. Code § 6147, a contingency fee contract must be in writing, and at the time the contract is entered into, the attorney must provide a duplicate copy signed by both the attorney and the client, except for contingency fee contracts for the recovery of workers’ compensation benefits.

A common mistake is signing a release without reading how costs come out of the settlement. Ask for an itemized accounting of costs before you sign anything. Questions about fee terms belong in the first conversation with a lawyer.

Medical Bills, Liens, and Reimbursement Claims

A lien is a legal claim on the money you recover.

Each one follows its own rules, so the details vary by program.

Separate the bills into three groups. Some are already paid. Some are still owed. Some are liens that attach to the recovery. Each group can be handled differently.

A lien amount can sometimes be negotiated. How much it can be reduced depends on the type of claim and the facts behind it. Ask for written lien and bill amounts before you accept any offer. For more on how these pieces fit together, read how much a lawyer can get you for a car accident.

Other Debts and Support Obligations That Can Apply

Open judgments and creditor claims can also change how funds are handled.

Tell your lawyer about any open judgment, lien, or support order at the very start. Raising these early helps everyone account for them before money changes hands.

Facts That Change How an Offer Is Measured

Injury severity, treatment, lost income, fault, and insurance limits all shape how an offer is judged. These are factors, not predictions of what any claim is worth.

Injury and diagnosis. Fractures, soft tissue injuries, and injuries that need surgery or long-term care are documented differently in the medical records. Some car accident injuries are serious. According to MedlinePlus, car accidents can cause spinal cord injuries that may result in permanent loss of movement, function, or sensation.

Treatment history. The length of care, gaps in treatment, and whether a doctor recommended the care all matter.

Lost income. Pay records and employer statements show time missed from work and any long-term effect on earning ability.

Damages types. Economic damages are objectively verifiable monetary losses, such as medical expenses and loss of earnings. Non-economic damages are subjective losses, such as pain, suffering, and emotional distress. Under Civ.
