Under Code of Civil Procedure § 377.60, the listed heirs may sue. These include a surviving spouse, a domestic partner, and children. A personal representative may also bring the claim on their behalf.

The same statute also covers people who depended on the person who died. This can include a putative spouse, stepchildren, parents, or a minor who lived in the household for the previous 180 days and relied on the decedent for half or more of their support. Families should identify who may qualify early.

A wrongful death claim arises when a death is caused by the wrongful act or neglect of another. Under Code of Civil Procedure § 377.20, a cause of action is not lost because the person died. It survives, subject to the applicable time limit.

Survival claims have their own limits. Under Code of Civil Procedure § 377.34, recoverable damages are generally limited to losses the decedent suffered before death, including any penalties or punitive or exemplary damages that the decedent would have been entitled to recover had the decedent lived. Pain, suffering, and disfigurement are generally not included, subject to narrow exceptions tied to specific filing dates.

What Has to Be Proven in a Hospital Wrongful Death Case

A family generally must show that a provider’s negligence caused the death. California defines professional negligence as a negligent act or omission by a health care provider in rendering professional services. That act or omission must be a proximate cause of the death, under Code of Civil Procedure § 340.5. Cal. Code Civ. Proc. § 340.5 reads: “(2) “Professional negligence” means a negligent act or omission to act by a health care provider in the rendering of professional services, which act or omission is the proximate cause of a personal injury or wrongful death, provided that such services are within the scope of services for which the provider is licensed and which are not within any restriction imposed by the licensing agency or licensed hospital.”

Most of these cases ask four questions. Did the provider owe the patient a duty of care? Did the care fall below the standard expected in similar circumstances? Did that failure cause the death? What losses did the survivors suffer? The Judicial Council’s CACI civil jury instructions cover negligence and damages, and show how these elements are presented at trial.

Causation is often the hardest link. The family must connect the care failure to the death, which takes careful medical review of what was done and when.

Medical records, a clear timeline, and review by medical professionals are typically needed. These sources show what care was given, what the chart recorded, and what the standard of care required.

How Hospital Liability Works When Several Providers Are Involved

A hospital can be responsible for its own staff and for some outside providers. The answer depends on how each provider is connected to the hospital. Civil Code § 3333.2 defines a health care institution as one or more health care facilities licensed pursuant to Chapter 2 (commencing with Section 1250) of Division 2 of the Health and Safety Code owned or operated by the same entity or its affiliates, and includes entities for which vicarious liability theories may apply. Those include respondeat superior (an employer’s responsibility for its workers) and ostensible agency (when a patient reasonably believes a provider works for the hospital).

Who employed a nurse or physician matters. The same statute says a health care provider includes the legal representatives of a health care provider and the provider’s employer, professional corporation, partnership, or other form of legally recognized professional practice organization. For a public hospital, a different rule applies. Under Government Code § 815.2, a public entity is liable for injury proximately caused by its employee acting within the scope of employment, if that employee would be liable on their own, but, except as otherwise provided by statute, not where the employee is immune from liability.

Emergency room care, anesthesia, and surgery often involve several providers. A single chain of events may involve a triage nurse, an emergency physician, a surgeon, and an anesthesia team.

Can a doctor be sued for delaying treatment? A delayed diagnosis or delayed treatment can be the basis of a claim. It matters when the delay falls below the standard of care and causes death. The timeline of who did what, and when, helps decide who may be named.

Deadlines That Can Make or Break a Hospital Wrongful Death Claim

For many medical negligence claims, the main rule is three years from injury or one year from discovery, whichever comes first. Under Code of Civil Procedure § 340.5, the claim generally must start within that window. The clock can start before a family understands what went wrong, because it runs from when the injury was discovered or should have been.

Under Code of Civil Procedure § 340.5, a medical negligence action against a health care provider must generally be started within three years after the date of injury or one year after the plaintiff discovers, or through reasonable diligence should have discovered, the injury, whichever occurs first. Cal. Code Civ. Proc. § 340.5 reads: “In no event shall the time for commencement of legal action exceed three years unless tolled for any of the following: (1) upon proof of fraud, (2) intentional concealment, or (3) the presence of a foreign body, which has no therapeutic or diagnostic purpose or effect, in the person of the injured person.” Code of Civil Procedure § 364 says no action may be commenced unless the defendant has at least 90 days’ prior notice. If notice is served within 90 days of the deadline, the time to sue extends 90 days from service.

A public hospital follows a much shorter clock. A claim for death must be presented within six months after it accrues, under Government Code § 911.2. This applies to a county-run or other public hospital, and it can come long before a family expects it.

Many personal injury claims carry a general two-year rule, subject to exceptions and tolling, according to the California Courts Self-Help Guide. Families should not assume the longest deadline applies.

Write down the dates of admission, key visits, discharge, and death. Note when concerns first came up. Early dates matter.

California Damages Limits and What Recovery Can Include

California limits some damages in these cases. Civil Code § 3333.2 Under Civil Code section 3333.2, in an action for injury against a health care provider or health care institution based on professional negligence, the injured plaintiff may recover noneconomic losses to compensate for pain, suffering, inconvenience, physical impairment, disfigurement, and other nonpecuniary damage. Those recoveries are subject to the dollar limits in that section, which are adjusted each January 1 as provided in its subdivision (g).

Economic losses are a separate category. These include bills and other money losses, such as medical costs, funeral costs, and the support a family member provided. The section’s limits focus on noneconomic losses, so the analysis of money losses works differently.

In a survival claim, pain and suffering are generally not recoverable under Code of Civil Procedure § 377.34. Both are easier while memories are fresh.

Ask for the full hospital and physician records. These include emergency room notes, nursing notes, and discharge summaries. Also request imaging, lab results, and medication administration records, with timestamps where available. Get the death certificate, and the autopsy report if one was performed.

Write a timeline of symptoms, requests for help, who was present, what staff said, and when each change happened. Keep copies of everything received, and note the date each record arrived.

Our team can help request and review these records.
