Injuries with little visible proof and mostly self-reported symptoms are usually the hardest to prove. Still, no single injury is the hardest injury to prove in every case.<\/p>\n

A claim has three proof steps. First, the injury must be shown to exist. Second, the crash must be shown to have caused it. Third, the injury’s seriousness and its effect on daily life must be shown. Each step needs its own evidence, and a claim can stall at any one of them.<\/p>\n

Documentation often decides which step gets stuck. Two injuries of similar severity can present very different proof problems, depending on what was recorded and when. Under California Civil Code section 3333<\/a>, except where the Code expressly provides otherwise, the measure of damages for breach of an obligation not arising from contract is the amount which will compensate for all the detriment proximately caused<\/a> thereby, whether it could have been anticipated or not. So the link to the crash matters as much as the injury.<\/p>\n
