Who pays out wrongful death settlements? Usually, the money comes from an insurance company or another party legally responsible for the death, not from the family’s own savings. Which party pays depends on the facts of the incident, and especially on who was at fault.<\/p>\n

The at-fault driver’s liability insurance<\/h2>\n

In many car, motorcycle, bicycle, and pedestrian cases, the at-fault driver’s liability insurance is the main source of payment. The policy limit often caps what that insurer pays, and it can shape early talks.<\/p>\n

California sets minimum liability limits for policies issued or renewed on or after January 1, 2025. Under Veh. Code \u00a7 16056<\/a>, those minimums are at least $30,000 for one person and $60,000 for two or more persons. Losses in a death case can exceed those minimums, and some drivers carry more.<\/p>\n

Vehicle owners can also be involved. Under Veh. Code \u00a7 17150<\/a>, every owner of a motor vehicle is liable for death or injury resulting from a negligent or wrongful act in operating the vehicle. Whether the owner was at fault turns on the condition, what the owner knew, and what was done about it.<\/p>\n

Dog bites follow a separate rule. Under Civ. Code \u00a7 3342<\/a>, a dog’s owner is liable for damages to a person bitten in a public place or lawfully on private property. That liability applies regardless of the dog’s past viciousness or the owner’s knowledge of it. The owner’s homeowner’s or renter’s liability policy may be a source of payment. How that statute applies to a death depends on how the bite happened.<\/p>\n

Manufacturers, government entities, and deadlines<\/h2>\n

Their insurers or corporate funds may then be part of the claim. These cases turn on the product and how it failed, so each one needs its own review.<\/p>\n

Claims against a city, county, or state agency follow the Government Claims Act. Under Gov. Code \u00a7 911.2<\/a>, a claim for death must be presented not later than six months after the cause of action accrues. That deadline is short, so families should look at the timing early.<\/p>\n

Lawsuits in general have their own clock. Under Code Civ. Proc. \u00a7 335.1<\/a>, an action for the death of an individual caused by another’s wrongful act or neglect must be brought within two years.<\/p>\n

Uninsured and underinsured motorist coverage<\/h2>\n

If the at-fault driver has no insurance, the family’s own policy may matter. Under Ins. Code \u00a7 11580.2<\/a>, bodily injury liability policies generally include uninsured motorist coverage, and the insured and insurer may agree in writing to provide coverage in an amount less than that required by subdivision (m), but not less than the financial responsibility requirements. That coverage protects the insured, the insured’s heirs, or legal representatives for sums they can legally recover for wrongful death from the owner or operator of an uninsured motor vehicle not owned or operated by the insured or a resident of the same household.<\/p>\n

The same law says an uninsured motor vehicle includes an underinsured motor vehicle. Cal. Ins. Code \u00a7 11580.2<\/a> reads: “As used in this section, \u201cuninsured motor vehicle\u201d shall not include a motor vehicle owned or operated by the named insured or any resident of the same household or self-insured within the meaning of the Financial Responsibility Law of the state in which the motor vehicle is registered or that is owned by the United States of America, Canada, a state or political subdivision of any of those governments or an agency of any of the foregoing, or a land motor vehicle or trailer while located for use as a residence or premises and not as a vehicle, or any equipment or vehicle designed or modified for use primarily off public roads, except while actually upon public roads.” Whether that coverage applies depends on the policies in place and how each one is written. Its insurer evaluates the claim separately from the at-fault driver’s insurer.<\/p>\n\n

How wrongful death money is divided among heirs<\/h2>\n

Eligible heirs are set by statute. Under Code Civ. Proc. \u00a7 377.60<\/a>, a surviving spouse, domestic partner, children, and issue of deceased children may assert the claim. If none survive, people entitled to the decedent’s property by intestate succession may assert it. Stepchildren, parents, putative spouses, children of putative spouses, and legal guardians (where the decedent’s parents are deceased) may also qualify if they were dependent on the decedent. A minor who, at the time of the decedent’s death, resided for the previous 180 days in the decedent’s household and was dependent on the decedent for one-half or more of the minor’s support may also qualify.<\/p>\n

The personal representative may bring the claim on their behalf. Under Code Civ. Proc. \u00a7 377.61<\/a>, the court determines the respective rights of the people entitled to an award.<\/p>\n
