You can ask for the offer in writing, take time to review it, and get advice before you sign anything. Insurers often reach out while families are still grieving and before the full losses are known. Here is what to weigh first.

You Do Not Have to Decide on the Spot

You do not have to accept, respond to, or sign anything on the first call or letter from an insurer. Adjusters often call within days of a death, when a family is still in shock. Asking for the offer in writing is a normal request. Ask for the amount, the terms, and what the payment would cover. Then give yourself time to read it.

Taking a few days before you answer is reasonable. Funeral bills are real, and that pressure is a reason to ask questions. It is not a reason to sign right away.

Remember that the insurer’s timeline is not the same as your legal deadlines. Write down the adjuster’s name, phone number, and claim number at the first contact. That way you can find them again.

If an adjuster has called about your loved one's fatal crash, you don't have to answer with a number on the spot, and we can go over the offer with you first. At the start, a family may know the funeral costs but not the final medical bills. Those bills can keep arriving for weeks.

Burial costs and medical expenses are economic damages. The law defines these as objectively verifiable monetary losses (Civ. Code § 1431.2). Larger losses take longer to document. These include lost income, lost household support, and the loss of a loved one’s companionship. Under the same statute, loss of earnings is classified as an economic damage, not a non-economic damage.

How much a family can recover depends on the facts of the case. Those facts include who the person was to the family and what they provided. Gathering them takes time. An insurer’s early number is a starting point, not a full evaluation.

California law also sets rules for how insurers must act. Ins. Code § 790.03 lists unfair claim practices. These include misleading a claimant about the statute of limitations, and failing to affirm or deny coverage within a reasonable time after proof of loss is submitted.

What Signing a Release Gives Up

A signed release generally ends the claim for good. Once you sign, the family usually cannot go back and ask for more. That stays true even if new losses appear or the offer later looks too low.

Read the release line by line before you sign. Check which parties it covers. It may release only the at-fault driver, or it may also release the vehicle owner, a business, or a property owner. A release that covers more than you expect can close options you didn’t know you had.

Look for lien or reimbursement language. Liens can mean part of the money goes to others who paid medical bills. Check for confidentiality terms and any language about future medical costs.

Many families focus only on the dollar amount. The scope of the release matters just as much. If anything is unclear, ask for a written explanation before you sign. The release is the final step in the claim, so it deserves the closest reading.

Who Can Bring a Wrongful Death Claim in California

A wrongful death claim is brought by certain close family members of the person who died. Under Code Civ. Proc. § 377.60, the decedent’s surviving spouse, domestic partner, children, and issue of deceased children may bring the claim, or, if there is no surviving issue of the decedent, the persons, including the surviving spouse or domestic partner, who would be entitled to the property of the decedent by intestate succession. Others may also bring it if they were dependent on the decedent: a putative spouse, children of a putative spouse, stepchildren, parents, or legal guardians if the parents are deceased. A minor who lived in the decedent’s household for the previous 180 days and depended on the decedent for one-half or more of the minor’s support may also bring it.

A survival claim is different. It covers the losses the person suffered before death, and a personal representative or successor in interest brings it. Under Code Civ. Proc. § 377.34, those damages generally do not include pain and suffering. The statute lists limited exceptions in subdivision (b).

Wrongful death damages are handled separately. Under Code Civ. Proc. § 377.61, damages may be awarded as may be just under all the circumstances. They may not include survival damages. The court decides how an award is divided among the people entitled to it.

Several people may share one claim. So ask who else holds rights before anyone signs anything.

How Fault and Multiple At-Fault Parties Affect an Offer

Fault can lower a recovery, but in California it does not automatically bar one.

Responsibility can also be split among several parties. Under Civ. Code § 1431.2, each defendant is liable for non-economic damages only for its own percentage of fault. An offer from one insurer may not account for every party who shares responsibility. An insurer may point to another driver, a commercial vehicle, a property owner, or a government agency.

Insurance limits matter too. For policies issued or renewed on or after January 1, 2025, the required bodily injury limit is $30,000 for one person and $60,000 for two or more persons in one accident (Veh. Code § 16056). A serious fatal crash can produce losses above those amounts.

If the at-fault driver has little coverage, your family’s own uninsured motorist coverage may apply. Jury instructions on comparative fault and damages are published by the Judicial Council of California.

Deadlines Families Should Not Overlook

In most California wrongful death cases, the lawsuit must be filed within two years. Code Civ. Proc. § 335.1 sets a two-year limit for actions for the death of a person caused by another’s wrongful act or neglect.

Claims against a public entity follow a shorter rule. Under Gov. Code § 911.2, a claim for death against a city, county, or state agency must be presented not later than six months after the cause of action accrues. “Accrues” means the point when the clock starts.

Uninsured motorist claims have their own clock. Under Ins. Code § 335.1, no cause of action accrues under that coverage unless specified actions are taken within two years from the accident.

These are separate timelines. Talks with an adjuster do not change any of them. Because a crash may involve a public road, a city vehicle, or government property, confirm which clocks apply early. Do not wait until after an offer is accepted.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

What to Say and Avoid With the Insurance Company

Stick to facts you can verify, and avoid guessing. Give the date, time, location, and vehicles involved. Do not guess about speed, distraction, or who caused the crash. Statements made in shock can be used later to dispute the claim.

Adjusters may ask for a recorded statement. You can ask what the recording is for and how it will be used before you agree. Do not sign medical authorizations or broad records requests until you understand what they let the insurer see. You can ask the insurer to limit a request to what the claim needs.

Official crash information is also available.
