Household services are the daily work a person did to keep the home and family running. Think of meals, laundry, school drop-offs, yard work, home repairs, errands, and childcare. Who Can Bring the Claim and Who Can Be Compensated<\/h2>\n

The surviving spouse, domestic partner, children, and issue of deceased children of the person who died can bring the claim, or, if there is no surviving issue, the persons who would be entitled to the property of the decedent by intestate succession. Cal. Code Civ. Proc. \u00a7 377.60<\/a> also covers other people, including the decedent’s personal representative, who may sue on the family’s behalf.<\/p>\n

Dependents can qualify even if they are outside that first group. The statute names a putative spouse, stepchildren, parents, or legal guardians, when the parents have died, if they depended on the decedent. A minor may also bring the claim. The minor must have lived in the decedent’s household for the previous 180 days and depended on the decedent for one-half or more of the minor’s support.<\/p>\n

The court decides how any award is shared. Under Cal. Code Civ. Proc. \u00a7 377.61<\/a>, the court determines the respective rights of the persons entitled to the award. Family members who relied on the household’s daily work are often well placed to describe that loss.<\/p>\n
