The driver’s logbook shows how long the driver had been working and driving. The truck’s electronic data can show what the vehicle was doing in the seconds before impact. Neither record tells the whole story alone, and both can be lost if no one asks for them early.

This guide explains what each record can show, what federal rules say about them, and why timing matters for families in Kern County and nearby communities. Colvin Accident Lawyers is based in Bakersfield, California.

A fatal truck crash is not an ordinary accident claim

A fatal crash involving a commercial truck usually leaves more records than a crash between two passenger cars. Trucking companies work under federal safety rules. Those rules create paperwork, electronic data, and trip records that a car crash usually does not.

The main categories are:

Driver hours records. These show when the driver was working, driving, resting, or off duty.

Electronic vehicle data. Onboard systems may record details about the truck’s operation near the time of the crash.

Dispatch and trip records. These show where the load started, where it was headed, and when it was due.

The police report. It records the scene, the parties, and the officer’s observations.

Together, these records help answer three questions. Who was driving? How long had that driver been on duty? What was the truck doing before impact? The answers shape the rest of the claim.

If a truck crash took your loved one's life, you don't have to sort out these records alone. It shows what the driver was doing, hour by hour, for each 24-hour period. Federal rules require drivers of property-carrying commercial vehicles to record that status, as 49 C.F.R. § 395.8 explains.

The core driving limits appear in federal driving-time rules. A driver may not drive without first taking 10 consecutive hours off duty. Except as otherwise provided in 49 C.F.R. § 395.1, which includes exceptions such as the short-haul exceptions, 49 C.F.R. § 395.3(a)(2) bars a driver of a property-carrying commercial motor vehicle from driving once 14 consecutive hours have passed since coming on duty following 10 consecutive hours off duty. Within that window, the driver may drive up to 11 hours.

The rules also cap work over longer periods. A driver may not drive after 60 hours on duty in 7 consecutive days if the carrier does not run vehicles every day of the week. If the carrier runs vehicles every day, the cap is 70 hours in 8 consecutive days. A 34-or-more-hour off-duty period can end either cycle.

Why does this matter after a death? These limits exist to address fatigue. A log that shows a driver near or past these limits raises a real question about how tired that driver was.

From paper logs to electronic logging devices

Many drivers now use an electronic logging device, or ELD. It records driving time without the driver writing each entry. A carrier required to use an ELD must use only a device on FMCSA’s registered list, as 49 C.F.R. § 395.22 states.

The device automatically records the date, time, location, engine hours, vehicle miles, and driver identity when duty status changes. While the truck is moving, it also adds an intermediate entry if an hour passes with no other recording. The data elements are set out in 49 C.F.R. § 395.26.

Electronic records can still conflict with other evidence. Investigators place these sources side by side. A gap between a logged break and a fuel receipt is a question the trucking company must answer. Federal rules also forbid making a false report about duty status and forbid tampering with an ELD so that it does not record accurately.

Black box data: what the truck’s onboard computer can record

Many heavy trucks have an onboard computer, often called an engine control module. It may store vehicle operating information. Depending on the make, model, and model year, that stored data may include details such as speed, braking, or throttle position. Not every truck stores the same details.

Pulling this data takes a careful, qualified process. Done correctly, it keeps the results reliable when they are challenged later.

Timing is central. Data from the seconds before impact can show whether the truck was slowing, braking, or speeding up in its final moments. Vehicle data is separate from the logbook, so it should be treated as its own record.

When logbook violations occur and how they fit into the claim

A logbook violation matters only when it connects to how the crash happened. Investigators look for a few common patterns. They check for driving past the 11-hour limit, skipped 30-minute breaks, and logs that conflict with receipts or dispatch messages.

A rule violation on paper is not the same as proof that it caused the collision. A driver who was over a limit earlier in the week presents a different question than one who was still driving after a long shift. The facts of the crash, the cause of death, and the timeline decide the link.

A second record matters after a fatal crash. When a commercial vehicle crash involves a loss of human life, the employer must test each surviving driver who was performing safety-sensitive functions for alcohol and controlled substances, as soon as practicable. If an alcohol test is not given within 2 hours, the employer must keep a record of the reasons. The alcohol test attempt ends after 8 hours. The controlled substances cutoff is 32 hours. These timing rules appear in 49 C.F.R. § 382.303.

Why trucking records can disappear quickly

Trucking records have time limits. Federal rules require a carrier to keep records of duty status and supporting documents for not less than 6 months from receipt, as 49 C.F.R. § 395.8 states.

Those are minimums. The same rules say they do not excuse compliance with longer requirements from another government body, as 49 C.F.R. § 379.3 explains.

Vehicle data has its own risk. A truck can be repaired, restarted, or returned to service, and stored information can be overwritten. That is why a written preservation request sent early is a common first step.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

Steps to take in the first days after a fatal truck crash

In the first days, gather the basic facts and put a preservation request in writing.
