In a fatal truck crash in California, that violation can become central evidence. Federal rules set how long drivers may drive and stay on duty. The records that show compliance, or the lack of it, are a useful place to start. This page explains the limits, where violations appear, and how they connect to a California wrongful death claim.

What Hours-of-Service Rules Are and Who They Cover

Hours-of-service (HOS) rules are federal limits on how long commercial drivers may drive and stay on duty. The detailed rules sit in 49 CFR Part 395.

Federal law lets the Secretary of Transportation prescribe requirements for maximum hours of service of employees of motor carriers, and of private motor carriers when needed to promote safety of operation, as 49 U.S.C. § 31502 provides. Under 49 C.F.R. § 395.1, the rules in this part apply to all motor carriers and drivers, except as provided in paragraphs (b) through (x) of that section. Some exceptions apply, so a crash on a California road can involve federal rules alongside state traffic law.

The limits cap how long a driver can stay behind the wheel before resting. The rules also work together, so breaking one limit can matter even when another limit was followed.

If you're trying to understand a fatal truck crash that took someone you love, we're glad to talk through the records and your options with you. The 14-hour period starts when the driver comes on duty after 10 hours off. The driver may not drive after those 14 consecutive hours end, even if driving time is still left.

Under 49 C.F.R. § 395.3(a)(3)(ii), except for drivers who qualify for either of the short-haul exceptions in § 395.1(e)(1) or (2), driving is not permitted if more than 8 hours of driving time have passed without at least a consecutive 30-minute interruption in driving status, and that interruption may be satisfied either by off-duty, sleeper berth or on-duty not driving time or by a combination of off-duty, sleeper berth and on-duty not driving time.

The weekly limits add another layer. Under § 395.3(b), a driver may not drive after 60 hours on duty in any 7 consecutive days if the carrier does not operate every day of the week, or after 70 hours on duty in any 8 consecutive days if it does. Under § 395.3(c), any period of 7 consecutive days may end when an off-duty period of 34 or more consecutive hours begins, and any period of 8 consecutive days may end the same way.

In limited cases, adverse driving conditions allow up to two more hours. That applies only when conditions keep a driver from safely finishing the run within the limits, under 49 CFR 395.1.

A violation can mean driving past the 11th hour, driving after the 14-hour window closes, or skipping a required break. Each limit is tied to clock times, so the records must show when each shift began.

How Hours-of-Service Violations Show Up in a Fatal Crash Investigation

Investigators compare a driver’s logged hours with other records to test whether the logs match the trip.

Under 49 CFR 395.8, carriers operating commercial motor vehicles must install electronic logging devices (ELDs) and require drivers to use them. The rule also allows manual logs in some situations, so investigators may see both kinds of records.

An ELD log is only one piece. Supporting documents, such as dispatch records, trip records, and expense receipts, help verify on-duty not-driving time. When the logs and those documents disagree, the gap is worth a close look.

Fatigue can also show up in the timeline. The hours before a crash can show when a shift started, whether a 10-hour rest came before it, and whether a break was taken.

Logs are not always accurate. Some entries are false or incomplete, and they can conflict with other data.

Records and Evidence Commonly Reviewed After a Fatal Truck Crash

Key records usually include the driver’s logs, supporting documents, the driver qualification file, post-accident test records, and vehicle inspection reports.

Under 49 CFR 395.11, a driver must submit supporting documents to the employer within 13 days of either the 24-hour period to which the documents pertain or the day the document comes into the driver’s possession, whichever is later. Under 49 C.F.R. § 395.11(c)(2)(i), a supporting document must include each of the following data elements: the driver’s name or personal identification number (PIN), or a unit (vehicle) number if the unit number can be associated with the driver operating the unit; the date, which must be the date at the location where the date is recorded; the location, which must include the name of the nearest city, town, or village; and, subject to paragraph (c)(2)(ii), the time, which must be convertible to the local time at the location where it is recorded. Under 49 C.F.R. § 395.11(d)(1), subject to paragraphs (d)(3) and (4) of this section, a motor carrier need not retain more than eight supporting documents for an individual driver’s 24-hour period under paragraph (c) of this section.

Under 49 CFR 391.51, a motor carrier keeps a driver qualification file. It includes the employment application, motor vehicle records, and the medical examiner’s certificate.

Periodic vehicle inspection reports must be kept for fourteen months from the report date, under 49 CFR 396.21. Because federal rules set these retention periods, asking for records early makes sense.

Does an Hours-of-Service Violation Prove Negligence in California?

An hours-of-service violation is evidence about the driver’s conduct. It does not automatically prove negligence under California law.

Whether a violation matters depends on the facts of the crash, including how the violation connects to what happened. A rule break that played no part in the crash is harder to tie to the harm.

In some cases, claims can also be based on how the company hired or supervised the driver.

Wrongful Death Claims Arising From a Fatal Truck Crash in California

In California, a wrongful death claim may be brought by certain surviving family members. The decedent’s personal representative may also bring it on their behalf.

Code of Civil Procedure § 377.60 lists who may sue. The list includes a surviving spouse, domestic partner, children, and issue of deceased children. Dependent relatives, such as stepchildren or parents, can also qualify. A minor who lived in the household for 180 days and relied on the decedent for half or more of support may qualify too.

Our wrongful death page explains the claim process in more detail.
