The number in an offer is usually the gross, and the net is what remains after fees, case costs, medical liens, and taxes are subtracted. So how much of a $20,000 settlement will I get? It depends on which deductions apply and how large they are. This page explains each category, the law behind it, and a labeled example you can use to check your own numbers. The net is what is left after those deductions are paid.

When a settlement offer or news story mentions $20,000, that figure is almost always the gross. Money goes to several places before the injured person or family receives it. Some payments come from a written fee agreement. Others are repayments owed to medical payers. Taxes can also apply to certain parts of a settlement.

Your own share of fault can lower the gross, too.

The sections below cover the deductions that most often reduce a settlement. No single number fits every claim.

Attorney Fees and Case Costs

Attorney fees and case costs are set by a written agreement, and that agreement shapes what you keep.

Under California law, a contingency fee contract must be in writing. The attorney and client must both sign a duplicate copy, and the client must receive it. The contract must state the contingency fee rate. It must also explain how disbursements and costs affect the fee and the client’s recovery (Bus. & Prof. Code § 6147). If a contract does not meet these rules, the client may treat it as voidable. The attorney may then collect a reasonable fee.

Outside of what a statute sets, the fee is left to the parties’ agreement (Code Civ. Proc. § 1021).

Case costs are a separate line. They can include filing fees, records fees, deposition transcripts, and reviews by medical or accident consultants. Ask how each cost is handled, how it affects the fee, and whether you would owe any costs if there is no recovery. The written agreement should answer each question.

Medical Bills, Liens, and Reimbursement Claims

Medical payers may claim repayment from a settlement. These claims are often called liens or reimbursement claims.

Medicare is the clearest example. The CMS attorney services page describes the federal Medicare Secondary Payer rules behind these claims.

Other payers can assert claims too. Those rights depend on their terms and the law that applies to each one.

A lien is not always the full billed amount. Some payers agree to reduce their claims, but no reduction is assured. Ask who holds each lien, how much is claimed, and whether it is still open.

Court Approval and Who Receives the Funds

Some settlements need a court’s review before money is paid. In wrongful death cases, California law also sets out who may bring the claim.

A wrongful death claim may be brought by a surviving spouse or domestic partner, by the decedent’s children, and by issue of deceased children, or, if there is no surviving issue, by the persons entitled to the decedent’s property by intestate succession, or by the decedent’s personal representative on their behalf (Code Civ. Proc. § 377.60). If they depended on the decedent, stepchildren, parents, and certain others may also bring it. A minor who lived in the decedent’s household for the previous 180 days and depended on the decedent for one-half or more of support may bring it too (Code Civ. Proc. § 377.60).

Damages are also limited. When a decedent’s personal representative or successor in interest pursues the decedent’s own cause of action, damages generally do not include pain, suffering, or disfigurement (Code Civ. Proc. § 377.34). The exception covers actions granted a preference under Section 36 before January 1, 2022, or filed on or after January 1, 2022, and before January 1, 2026 (Code Civ. Proc. § 377.34).

Payment timing can also differ from the date the settlement is agreed. Court-approved settlements can add steps before funds arrive.

Taxes on Personal Injury Settlements

Punitive damages are a separate category. In an action for breach of an obligation not arising from contract, California allows punitive damages only where oppression, fraud, or malice is proven by clear and convincing evidence (Civ. Code § 3294).

Tax treatment varies by type of payment. Ask a qualified tax professional to confirm how your own settlement is treated.

Not sure what your next step is?

Talk it through with our team — the first consultation is free, confidential, and carries no obligation.

Get a free consultation

Get a free consultation

A Hypothetical $20,000 Breakdown

In this illustration, a $20,000 gross settlement leaves $9,000 in hand.
